The Kerala High Court Advocates for Human Safety Amidst Stray Dog Concerns

In a recent ruling (TM Irshad & Anr. v. State of Kerala & Ors.), the Kerala High Court emphasized prioritizing human lives over those of stray dogs. Justice PV Kunhikrishnan highlighted the impact of stray dog threats on citizens’ daily lives, particularly affecting children and older people.

The Court observed that fear of stray dog attacks hampers activities like school commutes and morning walks. Despite potential opposition from dog lovers, the Court asserted the importance of prioritizing human safety.

Addressing the rising conflicts between humans and stray dogs, the Court emphasized the need for preventive measures while ensuring the humane treatment of animals. It urged local authorities to issue licenses to individuals willing to aid stray dogs, following the Animal Birth Control Rules, 2023.

Additionally, the Court called upon state and central governments to establish guidelines for granting licenses to dog protectors.

The judgment stemmed from petitions filed by residents of Muzhthadam ward, Kannur, who faced inconvenience due to a neighbor’s care for injured stray dogs. The Court directed the neighbor to obtain a license from the Corporation of Kannur to ensure compliance with animal welfare regulations.

Representatives for both parties included advocates Prajit Ratnakaran, E Mohammed Shafi, KR Avinash (Kunnath), Abdul Raoof Pallipath for the petitioners, and Senior Advocate KK Chandran Pillai, along with advocates S Ambily, Jikku Seban George, M Meena John, and Phijo Pradeesh Philip for the respondents. Government Pleader BS Syamantak represented the State government.
